Terms and conditions of sale on Shop-Diffusion.com

Shop-Diffusion.com is a division of the Willy Lugeon successeur Nicole Bally company (distribution, production, publishing) based in Froideville, Switzerland. Willy Lugeon successeur Nicole Bally is an independent musical distribution company founded in 1979.

Terms of payment
Each delivery comes with an invoice. Delivery against payment by credit cards (Visa, Mastercard), Yellowpay or advance payment (CCP or Bank).
Payments by credit cards (VISA/Mastercard) and Yellowpay include SSL (Secure Sockets Layer) security standard. Confidential data (card number, expiration date) are transmitted encrypted (coded) on the Postfinance server and are not transmitted on our server.
The order takes effect once relevant payment centres have validated the transaction. If the centres do not validate the transaction, the order cannot be taken into account and the customer is notified by e-mail. The consumer shall guarantee the Willy Lugeon successeur Nicole Bally company that he/she has the permissions required to use his/her bank card.
In case of payment by Visa card or Mastercard/Eurocard, your order shall only be credited on shipping of the items. In case of partial delivery, each shipping will be credited separately according to the delivery.

Terms of delivery
The terms of delivery can vary according to the availability of items. The items in stock are shipped as soon as possible. In case of inventory shortage, we will inform the customer of the necessary delivery times. Delivery is generally carried out by mail.

Shipping costs
We deliver without any freight charges throughout Switzerland. For deliveries outside the Swiss territory, an extra charge will be applied per item to cover freight charges via economic international postal mail.

For Switzerland: Free freight charges
Europe: an extra charge of CHF 2.90 per item
Rest of the world: an extra charge of CHF 3.80 per item

Exception: Oversize or overweight items may be subject to additional freight charges (Switzerland and abroad). In that case, they will be indicated on the page of the item at the time of your purchase.

Return right
Any item delivered by mistake or being defective shall be returned within 10 days in its unopened original packaging, with the corresponding invoice and a note explaining the reason for complaint. We shall not take back the items that do not suit your personal tastes, for author's rights reasons (except for defective items). Return costs shall be borne by the buyer.

Custom duties
Any good delivered outside Switzerland may be subjected to custom duties and taxes. Those custom duties and taxes shall be borne by you and shall fall within your responsibility.

Items/Prices
All our items are new items. The indicated prices are in Swiss francs and in euros (VAT at the legal rate applicable in Switzerland included). The prices indicated on the order confirmation have probative force.
Prices in euros may vary according to the current exchange rate. The prices indicated at the moment of your order have probative force.
Shop-Diffusion.com reserves the right to change its prices at any time. Items are invoiced according to the prices that were applicable when your order was validated.

Customer’s responsibility
The customer shall become responsible for the item once it has been delivered to him/her. For young people under 18, as well as for people under guardianship, the legal representative’s permission is mandatory. By accepting the terms and conditions of sale on Shop-Diffusion.com, the customer or the legal representative testifies to his/her responsibility.
 
Data protection
Personal information transmitted by the customer shall be treated in a confidential manner and shall not be used for any purposes other than the carrying out of the commercial transaction. No data shall be sold or transmitted to any third parties.

Downloadings
The purchases of musical albums and titles are firm and definitive.
As far as musical files are concerned, we remind you that they are protected by the regulations related to author’s rights. The buyer has the right to use those files only for personal purposes and in a private setting. Any use for purposes other than private purposes may expose the customer to civil and/or penal proceedings.

Place of jurisdiction
Swiss law applies. The relevant court is Lausanne.
